Agent Orange case up in the air
Lawyers representing Vietnamese victims of Agent Orange have asked the U.S. District Court in Brooklyn to reject a motion by the defendants to dismiss the lawsuit.
The Agent Orange lawsuit is against 37 U.S. chemical firms, and the plaintiffs' lawyers submitted an amended petition to the court that, they argued, contained significant new evidence that they had collected during a visit to Viet Nam.
The defendants had argued for the courts to dismiss the Agent Orange lawsuit on two different occasions, saying the time for legal proceedings in the case had expired and that dioxin was just an herbicide used in agriculture.
Lawyers for the defendants must submit their response to the plaintiff's amended petition by February 5, 2005. On February 28, the District Court will hold a hearing and lawyers from both sides can present their arguments based on if the court decides to proceed to trial.Please contact us to confer with an Agent Orange attorney.
